Legislative changes to the Portuguese Golden Visa

The new Amendment to Law 23/2007 (Foreigners' Law) comes into force on November 27, changing and providing for new possibilities for granting the so-called "Visa Gold", among other important changes.

The "Visa Gold" consists of an Authorization to Residence which waives the visa requirement for entrepreneurs making certain investments.

The investment required to obtain a stake in investment funds or venture capital funds aimed at capitalizing companies incorporated under Portuguese law has been reduced from 500,000 euros to 350,000 euros. However, the company being invested in must now have a maturity of 5 years and have at least 60% of its investments in commercial companies based in Portugal.

The following alternative for obtaining "Visa Gold" has also been added:

Transfer of capital in an amount equal to or greater than 350,000 euros, intended for the incorporation of a commercial company with its registered office in Portugal, combined with the creation of five permanent jobs, or Reinforcement of the share capital of a commercial company based in Portuguese territory, already incorporated, with the creation or maintenance of jobs, with a minimum of five permanent jobs, and for a minimum period of three years.

There is also the possibility of obtaining "Visa Gold" for the purchase of real estate worth:

1. 500,000 euros;

2. 350,000 euros for properties built at least 30 years ago;

3. 350,000 euros (purchase + work), in the case of properties pending rehabilitation, in which case work will be required to rehabilitate it, and the total cost of the purchase and work on the property must be equal to or greater than 350,000 euros.

These values are reduced in 20% if the property is located in a low-density area, areas with fewer than 100 inhabitants per km² or GDP below the national average.
